New Law Protects Estates from Elder Abusers

The Pennsylvania General Assembly passed an amendment to Title 20 (Decedents, Estates and Fiduciaries) on July 1, 2024.  The House amended the heading of chapter 88 to read, “Slayers and Elder Abusers.”  As a result, any person convicted of elder abuse cannot inherit or otherwise benefit from the estate of the victim.  Generally, the share that would otherwise pass to the abuser would instead go to the victim's estate depending on the asset type and the titling method utilized by the abuser.  This amendment is the result of Act 40 of 2024 (House Bill 1760).
