Pa Medical Practices Need to Know - Fair Contracting for Health Care Practitioners Act

As of January 1, 2025, Act 74 known as the Fair Contracting for Health Care Practitioners Act, prohibits noncompete agreements for certain health care practitioners.  The notable exception to this general rule is: "An employer may enforce a noncompete covenant if the length of the noncompete covenant is no more than one year, provided that the health care practitioner was not dismissed by the employer."

The Act defines Health Care Practitioners to include:

  1. a medical doctor;
  2. a doctor of osteopathy;
  3. a certified registered nurse anesthetist;
  4. a certified nurse practitioner; and,
  5. a physician assistant.
